Process

Five steps, in this order, with no skipping.

A real estate transaction is a sequence. Each step is closed before the next begins, so problems are not discovered after the money has already changed hands.

    Introductory meeting

    We clarify what you are buying or selling, the timetable and how it is financed. You leave with a clear picture of the risks and the costs.

  2. 02

    Property check

    Land registry extract, registration with the housing company or the Israel Land Authority, building permits, irregularities, liens, attachments and notes. This is how we identify in advance what could affect the deal.

  3. 03

    Negotiation and contract

    Drafting or amending the contract with the other side, including security mechanisms, penalties and a payment schedule aligned with your mortgage.

  4. 04

    Signing and payments

    Full support at signing, registration of a caveat, release of payments through the bank and supervision of the handover of possession on time.

  5. 05

    Taxes and registration

    Reporting to the real estate tax authority, handling assessments, deletion of liens and final registration of the rights in your name. Only then is the file closed.

About the firm

A boutique real estate law firm, at every level.

I am Yaacov Haggiag, Adv., a graduate of the law school of the University of West London in England and a member of the Israel Bar Association since 1999. A boutique firm established in 2005, dealing with real estate law at every level, alongside civil and commercial law and litigation.

Before I established the firm, I worked in the real estate departments of leading law firms, and then served as legal counsel to companies and building developers: complex real estate transactions, commercial contracts and representation in court. Among the projects I took part in: the initial planning stages of the municipal football stadium in Netanya and the “Ir Yamim” neighborhood along the city's coast.

My firm handles the purchase and sale of apartments, houses, plots, buildings and commercial premises, combination deals, developer projects, TAMA 38 and the representation of residents in community extensions of kibbutzim. The extensive experience I have gained allows me to identify problems in a transaction in advance, while they can still be solved.

FAQ

The questions that come up at every first meeting.

  • 01When should I involve a lawyer in a real estate transaction?

    Before you sign any document, including a memorandum of understanding or an order form with a developer. Such documents may bind you legally, and fixing things afterwards is far more expensive than checking beforehand, and sometimes impossible.

  • 02How much does legal support in a real estate transaction cost?

    The fee depends on the value and the complexity of the transaction, and is set in advance in a written fee agreement before work begins. At the introductory meeting you will receive a detailed proposal.

  • 03What is checked before buying an apartment?

    Who the registered owner is, which liens, attachments or notes are registered on the property, the state of registration in the land registry or with the housing company, and the expected tax exposure in the transaction.

  • 04Can I rely on the developer's lawyer?

    The developer's lawyer usually represents the developer, and a conflict of interest between the developer's interests and yours may arise. It is advisable to consider independent representation of your own in a transaction with a developer.

  • 05How long does a transaction take until registration in the land registry?

    The time varies with the type of transaction and the property. Final registration depends on the registering authority. In developer transactions, registration may take a long time, until the project is registered in the land registry by the lawyers accompanying the developer.

  • 06What is the difference between purchase tax and capital gains tax?

    In a nutshell, purchase tax is paid by the buyer and is calculated by brackets and by the number of apartments the buyer owns. Capital gains tax is paid by the seller on the profit made in the transaction, and an exemption may sometimes apply. Both are examined before signing.

  • 07I'm buying with a mortgage. Does that change anything?

    Yes. The payment schedule in the contract must be aligned with the bank's timetable, and precise documents and securities are required. A mismatch here may lead to delays and penalties.

  • 08We are a group of buyers facing a developer. Can we meet as a group?

    Yes. In TAMA 38 projects and community extensions of kibbutzim I meet with the buyers as a group, explain the agreement and the guarantees, and represent you before the developer throughout.
